修法降低公設比惹怒賴正鎰 「根本來亂的!」

內政部研擬今年5月修正「建築技術規則」,降低新建案公設比,對此,全國商總主席、
鄉林集團董事長賴正鎰表示,建商將被迫拉高房屋單價,更增實價登錄計算困擾,且二手
屋與新案法規不同,無法統一納管,質疑「政府根本來亂的」。
內政部修法草案方向,包含檢討現行「免計容積」的公設項目,除樓梯、電梯、消防設施
等必要公設外,其餘不必要公設將受檢討,而地下停車場免計容積也將訂定更合理的規範
;另外,內政部將加強交易過程中,對公設資訊透明度的要求。

賴正鎰今(15日)發新聞稿指出,公設共有部分並非虛坪,多為建築安全或設計所必需,
改為共有部分登記,僅改變單價的計價方式,無助壓低房價,若硬是拿掉公設,朝向實坪
制計價,僅會拉高房屋單價,徒增實登亂象與困擾。
賴正鎰舉例,若房屋一戶50坪、總價1000萬元,每坪原單價20萬元,扣除35%公設比的坪
數後,將變成32.5坪計價,建商依成本及收益,總價不變,每坪單價將飆高到30.7萬元。
他認為,修法後新舊制雜陳,預售屋、新成屋與中古屋不同,實登揭露將令人無所適從,
建議政府修法前三思。
建案公設區分「小公」、「大公」,前者指建物的兩支樓梯、電梯梯間等設施,由部分住
戶共同分擔的空間;後者包含機電設施、樓與樓之間連通道、門廳、管理室、避難室等,
由全體住戶共同分擔。
賴正鎰說明,一般建案大、小公合計,公設比至少22%,社區多會規畫管理中心與冷藏室
、KTV影音室、閱覽室、健身房、宴會廳、教室、遊戲室等休閒型公設,因此,新建大樓
配比豐富公設,公設比多在35%左右,住戶享有更好生活品質,「政府硬要介入規範,意
義不大,還會徒增困擾」。
法規修正後,針對地下室車道部分,未買車位住戶則無需分擔,賴正鎰指出,以使用者付
費原則出發,相當合理,不過,多數地下室設有蓄水池、垃圾集中站、化糞池,若將車道
、車位排除於公設面積,勢必引發爭議,不過,他認為,應可再討論攤提多少比例。(楊
